Summit Assisted a Client to Set up Successfully a Precedent of Obtaining an Injunction Order on Defendant’s Assets in Labor Dispute Arbitration Procedure 

近日，上海金英律师事务所代理客户在一起劳动争议纠纷案的仲裁阶段向上海市杨浦区劳动人事争议仲裁委员会提出了财产保全申请，并获得管辖法院——上海市杨浦区人民法院裁定支持。

Summit recently filed a motion on behalf of the client to Yangpu District Labor Dispute Arbitration of Shanghai during the arbitration procedure, requesting an injunction order on the defendant’s assets to ensure the outcome of this case. The motion was granted and People’s Court of Yangpu District thereafter issued an injunction order.

本案财产保全是自最高人民法院、人力资源社会保障部于2017年11月8日发布的《关于加强劳动人事争议仲裁与诉讼衔接机制建设的意见》（以下简称《意见》）颁布后，杨浦区第一例劳动争议纠纷案仲裁阶段的财产保全。

This injunction order represents a precedent in Yangpu District for the labor dispute arbitration case after the newly promulgated opinion ——《Opinions on Strengthening Building a Mechanism to Connect the Arbitration of Labor and Personnel Disputes and Litigation》issued by the Supreme People’s Court and the Ministry of Human Resources and Social Security jointly.

基于本案的被申请人存在歇业、恶意逃避执行的可能，为防止其转移财产，充分维护客户的合法权益，金英诉讼团队经过充分准备，结合最新出台的法律法规，及时提出财产保全申请，并获得了管辖法院的支持，最终成功冻结被申请人银行账户内资金，保障了案件后续的顺利执行。

After discovering the defendant’s bad intention of avoiding obligations to our client, our team prepared the motion based on the newly published opinion to ensure the client’s interests. The defendant’s bank accounts along with the funds in the accounts have been frozen by Yangpu district court.
